Meed2: Gallery19 Photo Competition

Meed2: Gallery19 Photo Competition

Gallery19 announces a call for entries for our Second annual juried competition, Meed2: New Abstraction. Photographers at all experience levels are invited to submit work. Artists selected as finalists will have their work exhibited (and available for purchase*) at Gallery19 for the month of July 2018. ** As competition judge, Juan Fernandez, artist and educator, will review all entries, select finalists, and announce the winner at an opening reception at Gallery19, on July 20th, 2018.

THEME: New Abstraction
Photography whether manipulated by hand, by computer, or physically exchanged, the image combines a function—an act of representation—with a use and history that constructs how that image communicates. Meed2: New Abstraction, looks at the materiality of film by exploring the nature of experimental photography. Through the practices of Pictorialism, Dadaism and Surrealist montage, Gallery19 and Juror Juan Fernandez explores the idea of new abstraction as it has reappeared in response to digital photography.

COPYRIGHT: Artist agrees that Gallery may use or display the Artworks or a photograph of the Artworks or permit the use or display of the Artworks or a photograph of the
Artworks only if notice is given to users or viewers that the Artworks were created by Artist.
Artist retains sole ownership of all work consigned to or represented by Gallery. Artist retains copyright to all consigned Artwork in perpetuity, as governed by law. USAGE RIGHTS: 1. Gallery shall utilize its best efforts to sell the Artwork(s) at the retail price specified on attached inventory (Ex. A). Gallery and Artist agree that Gallery’s commission from any sale is
50% percent of the actual sales price of the Artwork(s). When Artworks are purchased by designers or multiple pieces are purchased and a discount is asked in order to close the sale, Gallery may, at its discretion, give a discount of not more than 20%. By signing this Agreement, Artist authorizes Gallery to sell the Artwork(s) at or above the discounted price.

2. Retail sales price for each consigned Artwork will be established by Gallery in consultation with Artist. Factors influencing retail sales price include history of prior sales by Artist, market demand, and Gallery knowledge of its inventory, Buyers and price‐points.

3. Artist retains sole ownership of all work consigned to or represented by Gallery. Artist retains copyright to all consigned Artwork in perpetuity, as governed by law.

4. Artist hereby warrants that he/she created and possesses unencumbered title and rights to the Artworks, and that their descriptions are true and accurate.

5. Gallery will exert all reasonable efforts to close sales of consigned or represented Artwork. Artist agrees to provide Gallery, in a timely fashion and upon request, with any necessary documents or information in support of sales and to close on sale or a bill of sale.

6. Payment to artist will be provided within 30 days after the exhibition closes. If Gallery accepts installment payment sales, Artist agrees to accept partial payments as received by Gallery. Artwork will not be released by Gallery to Buyer until full payment is received. If Artwork is released to Buyer before full payment is satisfied, Gallery agrees to pay Artist full percentage of commission owed. Upon Artist request, Gallery will provide Artist with account statements of sales activity for all inventoried work attributable to Artist, at reasonably frequent intervals of approximately once each quarter.
7. Gallery will maintain insurance for fire/theft/vandalism, and declares that all consigned
Artwork will be covered by said insurance while in Gallery possession. Gallery shall insure
Artworks for its full wholesale price as listed on attached inventory (Ex. A). In the event an insurance claim is made, Gallery shall pay all deductibles. Reasonable efforts will be made to protect consigned Artwork from accidental damage, breakage or theft. Insurance liability for accidental damage or breakage is not provided by Gallery.

8. Following standard Gallery procedure, Artist agrees that this consignment is exclusive and that their Artwork (originals and duplicates) will not be displayed or shown in other galleries in the Ravenswood, Lincoln Square, and Andersonville areas while Artwork is displayed or placed with another gallery during stated contract term. Work accepted by Gallery will remain for entire duration of contract term. This practice stabilizes the Artwork value and provides a level of exclusivity during contract term, which benefits sales negotiations. Gallery will extend efforts to accommodate unique and special opportunities that arise, including participation in limited duration festivals and weekend events. For these opportunities, Artist must provide work from Artist’s own inventory.

9. Gallery agrees to hold on premises and display as appropriate all Artwork described on attached inventory (Ex. A), which is an addendum to this contract. The term of this Agreement is renewable upon agreement by both parties. This contract may be voided upon thirty (30) days’ notice by either party. Artist agrees that Gallery may use or display the Artworks or a photograph of the Artworks or permit the use or display of the Artworks or a photograph of the
Artworks only if notice is given to users or viewers that the Artworks were created by Artist.

10. Packing and shipping charges, insurance costs, other handling expenses, and risk of loss or damage incurred in the delivery of Artworks from Artist to Gallery and from Gallery to Artist are the responsibility of Artist.

11. Artist reserves all copyrights to the reproduction of the Artworks except as noted in writing to the contrary. Gallery may arrange to have the Artworks photographed to publicize and promote the Artworks through means to be agreed by both parties. In every such use, the
Artist shall be acknowledged as the creator and copyright owner of the Artworks. Gallery shall include on each bill of sale of any Artwork the following legend: “All copyrights to reproduction of the Artwork(s) identified herein are retained by the artist.”

12. It is understood by both parties that the consigned Artwork will remain housed at Gallery 19 until and unless it is released to a Buyer after payment of full purchase price. Gallery 19 assumes all risk if Artwork is loaned on approval to Buyer for potential sale.
13. Should the consigned Artwork remain unsold at the end of contract term, and if the contract term is not renewed, Artist must retrieve their work in a timely manner or send return mailing labels for Artwork to be shipped back to Artist at Artist’s expense.

15. In the event of a dispute between Artist and Gallery regarding this Agreement, such dispute shall be subject to arbitration before a single arbitrator pursuant to the rules of the American Arbitration Association. In the event that the parties agree upon the arbitrator, such person shall serve as the arbitrator. Otherwise, the arbitrator shall be appointed by the American Arbitration Association.

16. Under no event shall either Artist or Gallery be liable for consequential, punitive or exemplary damages. The parties sole and exclusive remedy shall be actual damages for any breach of the Agreement.

17. This Agreement shall be governed by and construed under Illinois law.
